Website Visitors

Except as described below, Smart CA, LLC. (Smart CA) does not collect or require users of it's service, http://www.Smart-CA.com/, to furnish personally-identifying information. Like most website operators, Smart CA collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Smart CA's purpose in collecting non-personally identifying information is to better understand how Smart CA's visitors use its website. From time to time, Smart CA may release non-personally-identifying information in the aggregate, for example, by publishing a report on trends in the usage of its service.

Smart CA also collects potentially personally-identifying information like Internet Protocol (IP) addresses. Smart CA does not use such information to identify its visitors, however, and does not disclose such information, other than under the same circumstances that it uses and discloses personally-identifying information, as described below.

Gathering of Personally-Identifying Information Members

Smart CA enables certain users to participate in or promote referral marketing campaigns for advertisers on the Smart CA network. Those users who would like to participate in a Smart CA campaign requires Smart CA to know a little bit more about them, i.e., personally-identifying information. To participate in a Smart CA campaign, users must provide their name and email address . Smart CA does not disclose personally-identifying information other than as described below. And users can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities (ie. participating in a Smart CA campaign).

Cookies

A cookie is a string of information that a website stores on a visitor's computer, and that the visitor's browser provides to the website each time the visitor returns. Smart CA and certain advertiser partners on the Smart CA network may use cookies to help Smart CA identify and track visitors, their usage of Smart CA service to participate in Smart CA campaigns, and their website access preferences. It is possible to link cookies to personally-identifying information. Smart CA, however, does not do so. Instead, it uses the information provided by cookies to develop a better understanding of how Smart CA's visitors use, and to facilitate those visitors interactions with, Smart CA's service. Smart CA visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before linking to Smart CA's website, with the drawback that certain features of Smart CA's website may not function properly without the aid of cookies.

Protection of Certain Personally-Identifying Information

Smart CA discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Smart CA's behalf or to provide services on behalf of Smart CA, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Smart CA's website, you consent to the transfer of such information to them. Smart CA does not, and subject to its right to change this policy (see below) does not currently have plans to, rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Smart CA discloses potentially personally-identifying and personally-identifying information only when required to do so by law, or when Smart CA believes in good faith that disclosure is reasonably necessary to protect the property or rights of Smart CA, third parties or the public at large. Smart CA takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Privacy Policy Changes

Although most changes are likely to be minor, Smart CA may change its Privacy Policy from time to time, and in Smart CA's sole discretion. Smart CA will alert all visitors as to whom it maintains personally-identifying information of any change to this policy, by email addressed to the most recently provided personal email address. Any and all changes will also be reflected on this page. Smart CA encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

Updating of Personally-Identifying Information, and Opt-Out

Smart CA permits its visitors to freely update, correct or delete any personally-identifying information maintained by Smart CA. To do so, visitors need only look for the links and other tools available on Smart CA's website or contact Smart CA by email. Visitors who no longer wish to receive materials distributed pursuant to a Smart CA mailing list should notify Smart CA by the same means.

Membership Eligibility

Smart CA's services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, Smart CA's services are not available to children (persons under the age of 18) or to temporarily or indefinitely suspended Smart CA members. If you are under the age of 18, you can use this service only in conjunction with, and under the supervision of your parents or guardians. If you do not qualify, please do not use Smart CA service. Further, your Smart CA account (including feedback) and User ID may not be transferred or sold to another party.

Fraud

Without limiting any other remedies, Smart CA may suspend or terminate your account if it suspects that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Smart CA service.

Restricted Activities

Your use of the Smart CA service to participate in certain Smart CA campaigns shall not: (a) be false, inaccurate or misleading; (b) be fraudulent or involve the sale of illegal services or items; (c) infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (d) violate any applicable law, statute, professional code of conduct, ordinance or regulation (including, but not limited to restrictions on sharing of fees, restrictions on giving referral fees, consumer protection, unfair competition, antidiscrimination or false advertising); (e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) be obscene or contain child pornography; (g) contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (h) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; and (i) link directly or indirectly to or include descriptions of goods or services that are prohibited under this Agreement or ones that you do not have a right to link to or include.

License

Solely to enable Smart CA to use the information you supply us with, so that we are not violating any rights you might have in that information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in your information, in any media now known or not currently known, with respect to your information. Smart CA will only use your information in accordance with our Privacy Policy.
